An employee only becomes entitled to family responsibility leave after he has met certain criteria set out in the BCEA, namely that he has worked for more than four months and works at least four days a week. The minimum entitlement is three days per year.
Leave can be taken in the event of:
vThe birth, death or illness of the employee’s child
vThe death of the employee’s spouse, life partner, parent adoptive parent, adopted child, grandchild, grandparent or sibling.
vA Male employee does not by law receive “paternity leave”, but is entitled to take family responsibility leave for the birth of his child.
TIP
An employee cannot accumulate any unused family responsibility leave or carry it over to the next leave cycle.
